Common Trucking Accident Questions
When the unexpected happens, it can be unnerving. A trucking accident is no exception. Here are some common trucking accident questions you might have – along with some sound advice.
I was just in a trucking accident – what’s the first thing I should do?
Before you do anything, call 911 first. Your health and that of all involved parties is important! Besides, you will want to make sure you are checked over, to establish documentation of any injuries. This could be important in your case later. Without immediate medical care, an unknown condition could be exacerbated. And besides, the insurance company cannot and will not pay on your claim without it. No one is just going to take your word for it.
What information should I exchange with the other parties to the accident?
First of all, provide only the basics to the other party. This means giving them your driver’s license, vehicle registration, and pertinent insurance info. Do NOT volunteer other information, or discuss the case. MAKE NO ADMISSIONS OF GUILT.
What about the cops?
By all means, call the police. When the officer interviews you, be as specific and clear as possible when recounting the events in the accident. Make simple, uncomplicated statements, free of exaggeration or embellishment.
Take pictures of the accident scene to be used for future reference and accompany and reports. Take pictures to illustrate the weather conditions, the location of all vehicles after the accident, the general accident scene, damage to all vehicles, license plates of all cars, and anything else that might help you with your case. You can never have too many pictures. Later, you will want to take pictures of your injuries to include bruises, cuts, and the like.
What about witnesses?
Let’s face it, no one is going to admit fault in a trucking accident… not the truck driver, and not the drivers of the other vehicle. Try to locate as many witnesses to corroborate the facts in the case. They can make or break your trucking accident case.
If the witnesses aren’t forthcoming about giving statements or contact information, don’t panic. As the cop to interview them on your behalf. Or, if potential witnesses attempt to leave the scene, take a picture of their license plate, and have the police trace the information to relocate the witness.
What about the other person’s insurance company?
Whatever you do, make no statements to anyone without contacting an attorney that specializes in trucking accident claims. This includes the insurance company for the other parties in the accident. They will try to trick you, coerce you, and despite their promises, they will use whatever you tell them against you. And, if the insurance company does get you on the phone, DO NOT let them record any statements you make.
